Do You Need a Permit for a Dumpster in Buffalo, NY?

The short answer

If the container sits on your own driveway, yard or private parking lot, the City of Buffalo has no dumpster permit for you to get. The City’s rule is about public property. If any part of the container sits on a street, the sidewalk, the tree lawn or any other public place, you need a permit before it arrives, and the City takes that seriously.

The rule: City Code § 413-4(C)

Buffalo City Code Chapter 413 (Streets and Sidewalks) says that no person may place a dumpster or similar large waste container in or upon the surface of any street, roadway or public place without first getting a permit from the Commissioner of Public Works. Two conditions come with it: the container has to be covered whenever it is not being loaded or unloaded, and it may not obstruct the public right-of-way. The fee is set in the City’s fee schedule (Chapter 175); confirm the current amount with the Traffic Division when you apply.

Who issues it and what they want

The permit is a street/sidewalk obstruction permit from the Traffic Division of the Department of Public Works, Parks and Streets, Room 512, City Hall, 65 Niagara Square, Buffalo NY 14202, phone (716) 851-5366, fax (716) 851-5364. The City’s own checklist asks for the following.

Submit at least seven business days in advance. A certificate of liability insurance naming the City of Buffalo as additional insured on both general and automobile coverage for at least $1,000,000. A maintenance and protection of traffic (MPT) diagram showing the work, the address and cross streets, the length of the obstruction, the width of the right-of-way at both ends, all signage and detours in line with the Manual on Uniform Traffic Control Devices, how many parking meters or paid spaces are affected, a pedestrian protection plan if the sidewalk is involved, and the start and finish dates. A business contact name and phone number. Fax it or hand-deliver it to Room 512. What it costs to skip it

An unpermitted dumpster on public property is a Class J violation under City Code § 137-7, which carries a $665 fine, and § 413-4(G) says every day the container sits there without a permit is a separate offence. The City may also remove the container at the owner’s expense. A permitted dumpster that breaks its permit conditions is treated the same way under § 413-4(H). Given the price of a rental, the maths is simple: keep it on private property or get the permit.

Demolition jobs have their own permits

A dumpster permit is not a demolition permit. Demolition in Buffalo goes through the Department of Permit and Inspection Services (apply online at epermits.buffalony.gov). Published fees from July 2025 are $300 to demolish a one- or two-family dwelling, $75 for a detached accessory structure over 144 square feet, and for commercial buildings $0.12 per square foot with a $500 minimum. Demolition without a permit carries a $1,500 penalty. Every demolition application is also referred to the Preservation Board, which gives an advisory recommendation within 60 days and can delay the demolition of an architecturally important building; in a historic district or on a landmark, a certificate from the Board is required first.

The suburbs are different

Each town and village writes its own rule, and they vary more than people expect. Cheektowaga requires Town Board permission for any obstruction in the road, sidewalk or tree lawn (Town Code § 210-21) but has no dumpster-specific permit. The Village of Depew has a written temporary-dumpster permit: $10 for residential property plus $35 a day after 14 days, $100 commercial plus $35 a day after 30 days. The Village of Lancaster requires a $25 permit for any dumpster at all, even on your own driveway, approved by the Village Board. Lackawanna lets the Chief Engineer permit up to a third of the street when the lot has no room. The villages of Orchard Park and Hamburg require written permission from their public-works chief for anything left in a street, for up to three months. Amherst, the Town of Tonawanda, West Seneca, Kenmore, the Town of Lancaster, the Town of Orchard Park and the Town of Hamburg publish no dumpster permit for private property.
